Position of the President

The 42nd Amendment Act, 1976 has removed all doubts about the position of the President. Now “there shall be CoMs with the PM at the head to aid and advice the President who shall, in exercise of his functions act in accordance with such advice.” The outcome is:

  • President could not play even the role of an advisor or a guide.
  • The 44th Amendment Act, 1978 says, ″ Provided that the President may require the CoMs to reconsider such advice, either generally or otherwise, and the President shall act in accordance with the advice tendered after such reconsideration.
