Protection of Life and Personal Liberty

  • No person shall be deprived of his life or personal liberty except according to procedure established by law.
  • Prior to Maneka Gandhi v. Union of India in 1978, Article 21 guaranteed the right to life and personal liberty to citizens only against the arbitrary action of the executive, and not from executive legislative action.
